UNHLPM Informal Consultations June 3, 2014: Statement by Russian Federation

“We regret the fact that the timetable for the forthcoming conference on a number of aspects not only goes beyond the parameters set by the modalities resolution but ignores the positions of a number of states including the Russian Federation which many times called for the need to maintain the international nature of the General Assembly and the events under the under the GA. Unfortunately our concerns are yet to be addressed. At the same time the delegation of the Russian Federation continues to believe in the need to unswerving abide by what was set down by the rights and rules regulating the rules of such negotiations. We hope that these concerns will be taken in account during forthcoming work on the draft outcome document.”

TRANSLATION: When the Tartars of Crimea show up at the UN, and present before the UN Permanent Forum on Indigenous Issues regarding the ramifications of the violations of the Rights of Indigenous Peoples as articulated in the UN Declaration on the Rights of Indigenous Peoples (2007), violations which could be interpreted as deliberate acts of Genocide, acts which equally implicate the Ukraine as a state sovereignty, there is NO WAY the Russian Federation will allow for Indigenous Peoples to be recognized as PEOPLES EQUAL to ALL OTHER PEOPLES in international procedures of the UN (a global system of state sovereignty established in 1648 under the Treaty of Wesphalia) when such recognition would not only call into question the territorial integrity of the Crimean peninsula, but the violations of Human Rights and Territorial Rights of Indigenous Peoples across the entire land base of the Russian Federation as a whole.

The ZERO DRAFT is just that: NOTHING of the drafting process is to the benefit of the Rights of Indigenous Peoples.

When the door closes, and the Final Outcome Document of this draft under UN International Procedures go into SILENCE MODE, the Rights of Indigenous Peoples will be an issue for the states to redefine on their own terms and the Nations of Indigenous Peoples themselves will be left outside facing the cold reality of having to contend with a strategy of collusion and co-optation by the UN states to subvert the UN Declaration on the Rights of Indigenous Peoples and prevent the International Human Rights referenced in the UNDRIP from ever becoming formalized in a UN CONVENTION.

"The HLPM is a semiotic schema (doctrine) being constructed to contextualize the process of INDIGENOUS CONSENT inside the Westphalian System of the Divine Right of States in order to subvert and domesticate the Universal Human Right in International Law of Indigenous Peoples, equal to all other peoples of the world."

We deny consent.

We call for the restitution of the primary source materials and testimony that was lent to the United Nations system as fundamental to the evidence in document form of the systemic (system to system) nature of the legal relationships between the Nations of Indigenous Peoples and the member states of the UN system for the purpose of the Treaty Study conducted by Dr. Miguel Alfonso Martinez of Cuba.

Such delivery, should be an initial act of good faith in terms of the continuing processes of systemic documentation among the Nations of Indigenous Peoples and the UN system prior to and as a necessary act of condition to allow for the full and effective participation of the Indigenous Peoples with the High Level Plenary Meeting on an equal basis and without systemic discrimination in the process of producing the Final Outcome Document of the High Level Plenary Meeting of the General Assembly 2014.

The UN General Assembly High-level Plenary Meeting 2014
IS NOT A UN CONFERENCE.

It is a schema of the states which is actively and openly but unrealistically being promoted to be named a CONFERENCE, in the same degrading naming process that we became known as INDIANS, AMERICA, AMERICAN INDIANS, LATIN AMERICA, etc.  The HLPM is a semiotic schema (doctrine) being constructed to contextualize the process INDIGENOUS CONSENT inside the Westphalian System of the Divine Right of States in order to domesticate the Universal Human Right in International Law of Indigenous Peoples, equal to all other peoples of the world.

We are Nations of Mother Earth, and will not consent to be diminished or to be dominated under the regime of the government states of the UN system as mere ethnic groups, or minorities.

WE DENY CONSENT.

Good Governance

and the

Territorial Integrity of Mother Earth

Therefore, in view of the High-level Plenary Meeting of the UN in 2014 and in relation to the interactive dialogue on the special theme of Good Governance of the UN Permanent Forum on Indigenous Issues, 2014, the Permanent Forum should address without discrimination violations of the right to self-determination and full and equal participation of Indigenous Peoples, equal to all other peoples in the concept, design, implementation and evaluation of each and every one of the UN actions and policies that involve our Indigenous Peoples and the protection of our collective rights.  In particular, regional trade agreements among member states of the UN, such as the North American Free Trade Agreement (NAFTA) and the imminent threat of Trans-Pacific Partnership Agreement (TPP for short English) should be juridically evaluated as instruments that violate of the right of Full and Equal Pariticipation as Peoples, equal to all other peoples.

Likewise, in evaluating with these same criteria the UNHLPM 2014, the lack of respect and consideration to be considered in Equality as Peoples with all other Peoples in the proceedings is evident from conception, completely absent from the design, not even being considered in the implementation, and there are no mechanisms integrate equality in the evaluation of the HLPM 2014 which is not a UN conference.  We see individual advisors being selected by extractive and non-representational processes, international peons whose role in the projected UN High Level Plenary Meeting of States of the General Assembly, which arrogantly is to be known as World Conference on Indigenous Peoples, is to repeat what the states have scripted to be told, facilitating the assault of neo-liberal colonization by the corporations that dictate the policies of the states, and whose role is to provide legitimacy for development projects which the international financial consortia require in order to market the concept that there is justice and consent of indigenous peoples.

H.E. MARJON V.KAMARA: African Group Statement HLPM

AFRICAN GROUP STATEMENT ON THE INFORMAL CONSULTATION ON THE ORGANIZATION OF THE HIGH LEVEL PLENARY MEETING OF THE SIXTY-NINTH SESSION OF THE GENERAL ASSEMBLY, TO BE KNOWN AS THE WORLD CONFERENCE ON INDIGENOUS PEOPLE:

DELIVERED BY: H.E. MARJON V.KAMARA, PERMANENT REPRESENTATIVE OF THE REPUBLIC OF LIBERIA TO THE UNITED NATIONS

Mr. President,

On behalf of the African Group which I represent for the month, I wish to thank you immensely for the efforts you have personally made in convening this informal dialogue on the "organization of high-level plenary meeting of the sixty ninth session of the General Assembly, to be known as the World Conference on Indigenous People". This is a recognition of the importance your presidency attaches to ameliorating the grave plight of the estimated 370 million indigenous people the world over.
We recall Mr. President,  that the General Assembly in 2004, proclaimed the Second International Decade of the World's Indigenous People (2005-2014) . That decade is almost past but the conditions of indigenous people  remain grim, severe and staid. Indigenous people continue to face threats as their social, cultural, economic and political distinctiveness are eroded.  This therefore behooves us to begin critical reflection and dialogue  on how to surmount the challenges  to achieving the decade.
Mr. President,
The African Group supports the idea of consulting all stakeholders including civil society, nongovernmental organizations, academia, national human rights institutions and parliamentarians, as a crucial exercise in sharing views on the contents of the Conference's Outcome document and their participation in the conference   proceedings.   However,   Africa   is   constrained   to  withhold its participation in this current deliberation due to its lingering concerns about the framework.

As you may recall Mr. President, prior to this meeting, the African Group had raised with you specific concerns about the need to safeguard the sanctity of the inter-governmental character of the process. The Group noted that regrettably, the framework you proposed did not take cognizance of this very critical principle.
It is our concern that the framework under which this consultation is taking place could set an unhealthy precedent that could unwittingly affect the very essence of the inter-governmental negotiation process as it has evolved thus far.

I THANK YOU
