Reunión Plenaria
de Alto Nivel de la Asamblea General
de Naciones Unidas y el uso Inadecuado del Consentimiento Previo Libre e Informado.
The High-level Plenary Meeting of the General Assembly of the United Nations to be held on 22 and 23 September 2014, makes manifest a set of situations of crucial character for the World's Indigenous Peoples that deserves its due attention and reaction:
1. Many efforts have been deployed, including international lobbying, coordination, time and hopes so that it be established as a norm of international law, the right to grant or Not Grant the Consent of Indigenous Peoples "in all matters affecting them". The Consent of Indigenous Peoples possesses the character of a qualified intrinsic relationship with other rights such as Free, Prior, and Informed Consent. However, this right which constitutes the fundamental tool of last resort available to Indigenous Peoples in any situation, has been canceled by the Indigenous themselves upon acceptance of the condition of absolute disadvantage in order to participate in the High Level Plenary Meeting of the General Assembly UN 2014.
2. The nomination of Mirna Cunningham and Les
Malezer as Advisers to Mr. John Ashe President of the UN General Assembly makes
evident that "some Indigenous", among them Mirna Cunningham and Les
Malezer are willing to offer consent to the reduction of the right of
self-determination, which participation makes definite, in spite of the
negative cost to Indigenous Peoples in general.
3. Based upon the nomination of Mirna Cunningham and Les Malezer, common sense indicates that it is of no utility or effectiveness that Indigenous Peoples are entitled to the right of self-determination and possess the right of Free, Prior, and Informed Consent, if in practice they are willing to give up all of these basic rights.
4. The Right of Free, Prior, and Informed Consent has as objective the defense and protection of other rights, which definitely these are the mechanisms and tools to establish acceptable conditions with any external body. The proper utilization of the Right of Free, Prior, and Informed Consent on the part of Indigenous Peoples accrues with experience, but the upon granting of consent without condition the results are predictable and set a precedent in favor of the government states.
5. I must emphasize that what has occurred in terms of the limited, scarce, and poor indigenous participation in the High Level Plenary Meeting of the General Assembly of the United Nations, is not a problem for the States, as governments they are doing what state governments do, but what forcibly brings attention is the conduct and behavior of the Indigenous themselves, who have not had the ability to acceptably use the tools which public international law itself has made available, such as the right of Free, Prior, and Informed Consent.
6. Every indigenous individual has a share of
responsibility for events in the international arena and I have mine. I worked
hard and tirelessly to install the Permanent Forum on Indigenous Issues of the
United Nations, but I never thought that this subsidiary body of ECOSOC would
absorb so quickly the international indigenous movement and render the
organizations of Indigenous
Peoples without a self determined agenda. It is observed that there are many
coordinating bodies of indigenous organizations with international coverage whose existence
and activity are based solely on the agenda of the Permanent Forum and other
activities of the United Nations system and so now in this manner is discarded a priori the setting of an international
agenda of Indigenous Peoples for themselves.
7. Mirna Cunningham has been criticized by Indigenous organizations themselves in consequence to her permanent political commitments to the government of Nicaragua. In this regard, I would appeal to Mirna Cunningham that there is still time to desist from such nomination, considering that the states of the world have many tools and political maneuvers to maintain a relationship of oppression over Indigenous Peoples and it would not be seen well seen nor be considered acceptable that a person of Indigenous origin become a political ploy for the government states in order to give appearance of indigenous participation in the High Level Plenary Meeting of the General Assembly of the United Nations. Similarly, all Indigenous Peoples who are interested in this matter have time yet to convey a clear message to the President of the General Assembly and government states, both before and during the High-level Plenary Meeting and clearly there should be consideration for canceling the event.
8. All of the messages and very legitimate communications from indigenous organizations addressed to John Ashe, President of the General Assembly that have been transmitted have not had a positive and concrete effect, to the contrary the president's decision has remained unchanged for this reason I have chosen to address my indigenous relatives, Mirna Cunningham and Les Malezer with the objective to analyze the consequences and the precedent established in the wake of such a reduced and limited indigenous participation in the High Level Plenary Meeting.
9. I consider that the Indigenous Caucus prior to
the next session of the Permanent Forum on Indigenous Issues in New York 2014, provides
an opportunity to discuss and jointly establish a firm and decisive position
and that the right of CONSENT be properly used in favor of Indigenous Peoples
and their rights.

La Reunión
Plenaria de Alto Nivel de la Asamblea
General de Naciones Unidas a efectuarse los días 22 y 23 de septiembre 2014, pone de manifiesto un conjunto de situaciones de carácter
crucial para los Pueblos
Indígenas del Mundo que merece su debida atención
y reacción:
1. - Se desplegó
tantos esfuerzos, lobby internacional, coordinación, tiempo y esperanzas para que se estableciera en una norma de derecho
internacional, el derecho a otorgar o No otorgar
el Consentimiento de parte de los Pueblos Indígenas en “todos los asuntos
que les afectan”. Cuyo Consentimiento tiene un carácter
calificado de intrínsecas relaciones con otros derechos como es el Consentimiento Libre
Previo e informado. Sin embargo,
este derecho que constituye la herramienta fundamental y último recurso que disponen los Pueblos
Indígenas ante cualquier situación, ha sido anulado por los propios
indígenas al aceptar las condiciones de absoluta
desventaja para la participación en la Reunión Plenaria de Alto
Nivel de la Asamblea General
de Naciones Unidas.
2. - La nominación de Mirna Cunningham y Les Malezer
en calidad de Asesores ante el señor John Ashe Presidente de la Asamblea
General de Naciones
Unidas pone de relieve que “algunos indígenas” y entre ellos Mirna Cunningham y Les Malezer
están dispuestos a otorgar
su consentimiento en desmedro
del derecho a la autodeterminación, en definitiva a participar a cualquier
costo negativo para los Pueblos
Indígenas en general.
3. - A raíz de la nominación de Mirna Cunninham y Les Malezer,
el sentido común indica que no tiene ninguna
utilidad, ni efectividad que los Pueblos Indígenas sean titulares del derecho a la autodeterminación y dispongan
del Consentimiento Previo
Libre e Informado, si en la práctica están dispuestos a renunciar
a todos estos derechos elementales.
4. - El Consentimiento Previo Libre e Informado, tiene por objeto cautelar y proteger
otros derechos, en definitiva estos son los mecanismos y herramientas para establecer condiciones aceptables ante cualquier
ente externo, su utilización adecuada de parte de los indígenas reportaría una determinada experiencia, pero el otorgamiento del consentimiento sin condicionar los resultados son predecibles y sentará
un precedente
a favor de los gobiernos.
5. - Debo subrayar que, lo que ha sucedido en cuanto a la limitada,
escasa y pobre participación indígena en la Reunión Plenaria de Alto Nivel de la Asamblea
General de Naciones Unidas,
no son problemas
de los Estados, los gobiernos
están haciendo lo suyo, sino,
lo que llama poderosamente la atención
son las conductas
y comportamientos de los propios indígenas, que no han tenido la capacidad
para utilizar aceptablemente las herramientas que el propio derecho internacional público les
ha puesto a disposición, como es el Consentimiento Previo
Libre e Informado.
6. - Toda persona indígena
tenemos una cuota
de
responsabilidad en los hechos en el ámbito internacional y yo tengo la mía. Yo trabajé dura e incansablemente para instalar el Foro Permanente sobre Cuestiones Indígenas de las Naciones
Unidas, pero nunca pensé que este órgano subsidiario del Ecosoc
absorbería con tanta rapidez
al movimiento indígena internacional y dejaría sin agenda a las organizaciones de los Pueblos
Indígenas. Se observa
que muchas coordinaciones de organizaciones indígenas con cobertura internacional su existencia y actividad
están basadas única y exclusivamente en la agenda del Foro Permanente y las actividades de Naciones
Unidas y de esta manera ahora descartan a priori establecer una agenda internacional propiamente
de los Pueblos Indígena.
7. - Mirna Cunningham, ha sido criticada por las propias organizaciones Indígenas a raíz de sus permanentes compromisos políticos con los gobiernos
de Nicaragua. A este respecto,
quisiera interpelar a Mirna Cunningham a que todavía está a tiempo para que se desista de tal nominación, considerando que los Estados del mundo tienen muchas herramientas y maniobras políticas para mantener una relación
de opresión con los Pueblos Indígenas y no sería bien visto ni aceptable
que una persona
de origen indígena se convierta
en una ficha política
de los gobiernos para una aparente
participación indígena
en la Reunión Plenaria
de Alto Nivel de la Asamblea
General de las Naciones Unidas.
Del mismo modo todos los indígenas interesados en este asunto estamos
a tiempo para trasmitir un mensaje
inequívoco al presidente de la Asamblea General y
para los gobiernos tanto, antes y durante la Reunión
Plenaria de Alto Nivel y evidentemente se debe considerar la cancelación del evento.
8. - Todas las notas y comunicaciones muy legitimas
de parte de las organizaciones indígenas dirigida al seños Jhon Ashe Presidente de la Asamblea General
que se han trasmitido no han surtido efectos
positivos y concretos, al contrario la decisión del presidente se ha mantenido
invariable, por esta razón he preferido dirigirme a mis hermanos indígenas, a Mirna Cunningham y Les Malezer con el objeto de analizar
las consecuencias y el precedente que establecerá a raíz de la reducida
y limitada participación indígena en la Reunión
Plenaria de Alto Nivel.
9. - Considero que el Caucus Indígena
previo a la sesión del Foro Permanente sobre Cuestiones Indígenas en Nueva York 2014, tiene una oportunidad para debatir y fijar conjuntamente una
posición firme y decidida
y el Consentimiento sea utilizado adecuadamente a favor
de los Pueblos Indígenas y sus
derechos..
